Terms and Conditions

By accessing or using BGS products or services, you agree to abide by these terms and conditions, which may include important information about privacy, security, and legal rights.

1. Detailed description of goods and/or services

Brink Gutter Supplies Close Corporation is a business in the manufacturing and supply industry that provide high-quality gutter component products and solutions.

2. Delivery and return policy

Subject to availability and receipt of payment, requests will be processed within 2 working days and delivery confirmed by electronic communication.

We want you to be happy with your purchase. If you are not completely satisfied, you can return the product to us and we will replace it. This Policy applies to products purchased from Brink Gutter Supplies itself.

Certain parts of this Policy do not apply to Unboxed Deals, reconditioned products or used products.

This Policy forms part of the Brink Gutter Supplies Terms and Conditions, and so words defined in the Terms and Conditions have the same meaning in this Policy, unless the context indicates otherwise. Nothing in this Policy is intended to limit your statutory rights in any way.

Preparing your products for a return

To ensure your request is processed as timeous as possible you are responsible for the following when returning your products;

  • package your products safely and securely for protection during transit;
  • clearly mark your return reference number on the outside of the parcel; and
  • include all accessories and parts that were sold with the product.

Failure to adhere to any of these requirements could delay the processing of your request or result in its decline altogether.

2.1 Unwanted products

You can return an unwanted product to us at a 10% admission fee, provided –

  • it is undamaged and unused, with the original labels and stickers still attached if there are any.
  • save in relation to Unboxed Deals, reconditioned products and used products, it is in the original packaging, which must be undamaged and in its original condition with all seals still intact (if applicable).
  • it is not missing any accessories or parts.
  • you return the product in good condition at your own expense.
  • product is returned within 7 days of purchase.


Changed your mind?

You can exchange a product at a 10% admission fee (This does not include custom-made products like the OGEE gutter and box gutter. Customers are required to courier or return the product at their own expense).

Not what you ordered?

If we accidentally deliver the incorrect product to you, or if the product is not as described on the Website, please notify us and we will collect the product from you at no charge and replace it. If the product is missing any accessories or parts, you will need to follow the process set out in section 2 below. Once we have inspected the product and validated your return, we will deliver the correct product to you as soon as possible (if the correct product is available).

2.2 Products damaged on delivery

Should a product be damaged or missing any parts or accessories at the time of delivery/collection, please notify us within 7 days of such delivery/collection by contacting us.

We will arrange to collect the product from you at no charge. Once we have inspected the product and validated your return, we will replace the product as soon as possible.

2.3 Defective products

We do our best to ensure that the products we deliver to you are of a high quality, and in good working order and without defects.

What is a defect?

A defect is a material imperfection in the manufacture of a product or any characteristic of a product, which makes the product less acceptable than one would reasonably be entitled to expect in the circumstances.

The following will NOT be regarded as defects and will not entitle you to a return under this section 3:

  • faults resulting from normal wear and tear;
  • damage arising from negligence, user abuse or incorrect usage of the product;
  • damage arising from electrical surges;
  • damage arising from a failure to adequately care for the product;
  • damage arising from unauthorized alterations to the product;
  • where the specifications of a product, although accurately described on the Website and generally fit for its intended purpose, do not suit you; and
  • in relation to Unboxed Deals or used products, signs of handling and/or repackaging.

3. Export restriction

The offering on this website is available to South African clients only.

4. Customer Privacy policy

This Privacy Policy applies to all users of our Website. which are used to access and purchase our products.

The purpose of this Privacy Policy is to set out how, why and when Brink Gutter Supplies uses your Personal Information so as to comply with the Protection of Personal Information Act 4 of 2013 (“POPI”).

It is important that you read this Privacy Policy together with our other terms and conditions, privacy notices or policies.
Further, please pay special attention to the clauses in this Privacy Policy that appear in similar text and style (i.e. bold) which:

  • may limit the risk or liability of Brink Gutter Supplies or a third party.

We strive to deliver excellent service every time you shop with us, and to do this, we need to use some of your Personal Information.   • “Personal Information”, and “process/processing” bear the same meanings as set out in POPI.
  • “we”, “us” or “our” refers to Brink Gutter Supplies.
  • “you” and “your” refers to every person that accesses or uses our Platforms also referred to as a user.

We strictly only use your personal information to accurately process payment and delivery. Personal information can also be used to contact the user in regards of queries and to send updates on process of order.

When using our Platform, we may collect the following Personal Information:

  • Name, surname and business name (if applicable).
  • email address.
  • physical address.
  • mobile phone number.

You warrant that the information you have provided is accurate, current, true and correct and that does not impersonate or misrepresent any person or entity or falsely state or otherwise misrepresent your affiliation with anyone or anything.
Information from using our Platforms

Why do we process your personal information?

We process the Personal Information we collect and receive to:

  • enter into a contract with you.
  • To deliver products to the correct location

Retention and restriction of records

  • we need it to provide our Platforms, products or services to you.

  • it is necessary to uphold the contract between you and us.

Who else gets to process your personal information

We do not sell your Personal Information to third parties for their marketing or any other purposes.

  • our employees, the staff of the companies in the Brink Gutter Supplies or third party service providers in order to enable them to assist us to interact with you via our Platforms for the ordering, collecting or delivery of goods.

We secure the integrity and confidentiality of your Personal Information in our possession or under our control by taking appropriate, reasonable technical and organisational measures to prevent loss of, damage to or unauthorised destruction of Personal Information; and unlawful access to or processing of Personal Information.

Should you disclose your Personal Information to any third party other than Brink Gutter Supplies, Brink Gutter Supplies shall not be liable for any loss or damage arising or suffered by you as a result of the disclosure of such Personal Information to any third party. This version of the Privacy Policy replaces any preceding privacy policy provisions on our website. We may occasionally update this Privacy Policy. When you use our Platforms the version of the Privacy Policy posted on this page applies to you.

5. Payment options accepted

Payment may be made via Visa, MasterCard or by bank transfer into the Brink Gutter Supplies bank account, the details of which will be provided on request.

7. Card acquiring and security

Card transactions will be acquired for Brink Gutter Supplies via PayGate (Pty) Ltd who are the approved payment gateway for all South African Acquiring Banks. PayGate uses the strictest form of encryption, namely Secure Socket Layer 3 (SSL3) and no Card details are stored on the website. Users may go to www.paygate.co.za to view their security certificate and security policy.

8. Customer details separate from card details

Customer details will be stored by Brink Gutter Supplies separately from card details which are entered by the client on PayGate’s secure site. For more detail on PayGate refer to www.paygate.co.za.

9. Merchant Outlet country and transaction currency

The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. Transaction currency is South African Rand (ZAR).

10. Responsibility

Brink Gutter Supplies takes responsibility for all aspects relating to the transaction including sale of goods and services sold on this website, customer service and support, dispute resolution and delivery of goods.

11. Country of domicile

This website is governed by the laws of South Africa and Brink Gutter Supplies chooses as its domicilium citandi et executandi for all purposes under this agreement, whether in respect of court process, notice, or other documents or communication of whatsoever nature.

12. Variation

Brink Gutter Supplies may, in its sole discretion, change this agreement or any part thereof at any time without notice.
